stand with obamacare? it seems as though the effort to repeal it to the courts is vain and energy. >> there are a lot of robust efforts and others around the country. they will move their way to the system. at some point, the religious liberty issued well, i believe, did the united states supme court. not specifically this case, but that involving the roman catholic church. one will get the united states supreme court, and we will eventually have it. lou: very quickly, just a little time left here. seventeen states setting up those exchges. this is starting tlook like a commend th problem. >> oh, it's a problem and i don't think they will be able to make it. a lot of states say that we are not going to clen up your mess. some studies show that because of these exchanges, health care insunce premiums will be more expensive rather than expensive a concentration in one market and one company. it usually means lower prices for consumers. they are trying to do the opposite and it is a mess lou: it has been a mess from the beginning. >> absolutely, and it's only going to get worse. lou:

earnings shares of the s&p are in financials, energy, materials, industrials, and those sectors would get the rating on growth confidence. one of the things the bears aren't pointing out is that since the s&p down grade of u.s. debt, the s&p is up 200 points and earnings estimates for this year are down by 11, should be the strongest part. >> barry, it's joe. the beginning of 2013, we get to 1600. the question then becomes is that some form of a secular talk? selling at that point? what happens thereafter? >> you know, we've been in a 1200 plus or minus 400 range since the late '90s. this is a secular bear market. we've been through four of them in the past 100 years, the most recent was 1967 to 1982 so, yeah, i'm a little concerned that once we get to a top p/es rerated, earnings growth not that strong, that it will be a little harder to plow ahead from that level. we'll need more growth globally. >> it's good to have you on. thanks for coming on today. we'll have you back soon. >> thanks. >> appreciate having you. barry bannister. forget the target of 1600. it doesn't mean that much to

, telecom, utilities. a lots of people play dividend at the end of the year. energy and materials a little bit deceptive. for example, energy has only been up a few of the last decembers. it's had a couple of real terrific decembers. i want to note there's only one sector that's averaged down in december for ten years. believe it or not, it is tech which obviously had a terrible 2002 but also had a particularly terrible 2009. you can get some real volatility in the tech sector. >> you really have to look at the last ten years trading performance in some of these before you make a decision. >>> one of the big stories rolling out throughout the day -- a november to remember for the automakers. carmakers revving up some big sales but some of it was because of super storm sandy. our phil lebeau is behind t wheel in chicago. >> we knew this would be a better than expected november and look at these numbers. generally speaking with a few exceptions, all of the automakers reported better than expected results last month. gm being one of the exceptions, being just a little bit below expectations.

are on the rise and another pulse of energy pointing its way right at northern california. it will be the fourth pulse of heavy wind, rain and snow coming into this area over a five-day period. look at some of the damage out of oakland. a number of homes damaged because of flooding and rains there. roads damaged as well this is widespread, across the bay area, southern parts of oregon, just the infrastructure can't handle this moisture and underwashing some of these roadways. rescues, high water rescues yesterday and over the weekend. you can just imagine when some of these small streams come up and over the roadways, if you're driving through them people get stuck. the crews are brought in to try to get the job done and folks to safety. across napa valley, incredible flooding there. the napa valley seeing some of its worst rainfall in years. look at these numbers. petrolia, california, over 17 inches. bridgeville, 15 inches. that's an incredible amount of rain. to see that much rainfall is truly remarkable. we are seeing more in the way of rainfall across seattle and portland it has stopped for

. this will sink further south, we'll get another piece of energy later on today that will spin up across the bay area and intensify the rainfall. that's what we will be watching closely. our computer models highlight that. one pulse to the north. another one fills in further to the south. it shouldn't be nearly what we saw last week. the ground is saturated. rivers are swollen. it won't take much to get more in the way of flooding. once we get past that, we are looking at a fairly dry scenario going over the next few days. today is the day. then tomorrow we'll hopefully be breathing a sigh of relief. >>> this morning intense fighting in syria outside the city of aleppo. rebel fighters trapped hundreds of government soldiers inside a military base and say they are giving them a chance to defect. this as president obama warns syrian president bashar al assad that there will be serious consequences if he uses chemical weapons against his own weapon. >> this regime is a real problem for us. its alliance with iran, its possession of chemical weapons, weapons of mass destruction. its human rights reco

is up. totally out of tune. let's check out the latest news in energy and metals with sharon epperson at the nimax. >> traders on the nimax floor say they don't want to stick their necks out right now not ahead of the weekend not knowing what will happen with the u.s. budget resolution. there's too much uncertainty here and that's a big reason why you are looking at basically flat prices across the board in the energy complex. we're looking at oil prices basically in a holding pattern here under the 88.50 level for wti crude and around 110 for brent crude price. when you look at what's happening in oil prices over the course of the week, we're where we are a week ago and cliff on and cliff off talks keep traders with little incentive to trade the flat price. in terms of gold market, we're looking at the february contract here as the most active contract for gold and there we have seen a lot of price action in the gold market this week. we've seen record volume here at the cme in terms of the gold trade. prices right in the middle of the range they've been trading in around the 1725 ma

know that if you would police this information and reporting requirements by the energy information agency, that we could have a better analysis of what is causing undue spikes in the market. we have a lot of analysis that shows that it is not supply and demand. so, when it's something as critical as the price of gasoline, you know, there's more regulation on commodities like hamburger than there is right now on gasoline. and i can tell you gasoline is a lot more important to an economy than the kinds of transparencies that we have in the commodities market. >> now there was at one point i think one or more refinery fires and that was one explanation given at a certain stage and also the seasonal adjustments when they are switching over from home heating to gasoline. but you don't think that any of those factors are what really caused these spikes some. >> well, what happened is one refinery had a fire. that was in the state of washington. and when prices almost went to $5, people were saying, how does one refinery cause that kind of spike? and all the other refineries responded wit
